Minutes

The Andover City Planning Commission met for a regular meeting on Tuesday, August 19, 2003 at 909 N. Andover Road in the Andover Civic Center. Chairman Quentin Coon called the meeting to order at 7:03 p.m. Commission Members present were Clark Nelson, Charlotte Bass, Jan Cox, Lynn Heath, and City Council Liaison Keith Zinn. Others in attendance were Zoning Administrator Les Mangus, Administrative Secretary Deborah Carroll, and City Clerk/Administrator Jeff Bridges. Commission members Ron Roberts and Dave Martine were absent.

Call to Order

 

 

Review of the minutes of the July 15, 2003 Planning Commission meeting.

Lynn Heath made a motion to approve the minutes as presented. Clark Nelson seconded the motion. Motion carried 5/0.

Communications:

Review of City Council minutes of July 8, 2003 and July 29, 2003 meetings.

Chairman Quentin Coon noted the minutes as accepted as presented.

Review of Site Plan Review Committee minutes of the August 5, 2003 meeting.

Review of Subdivision Committee minutes of the August 12, 2003 meeting.

Chairman Quentin Coon noted the minutes as accepted as presented.

Review of the Potential Residential Development report.

Staff Reports:

Les Mangus stated Jeff Syrios has been appointed by the City Council to fulfill the unexpired term of Charles Malcom on the Planning Commission. Mr. Syrios was unable to attend tonight's meeting and sent his apologies.

Les Mangus said the applicant for the vacation of street right-of-way on Timothy Road withdrew the case after he got a better understanding of what he was asking for. The case was advertised and notices sent, but the Planning Commission will not hear this case.

Review the Preliminary Plat of the Course at Green Valley 10th Addition.

Kenny Hill of Poe and Associates, representing the applicant said the Green Valley 10th Addition plat fills in all of the area that has not been platted in the residential part of Green Valley east of the golf course. There are patio homes on this plat that weren't originally planned for this area but an amendment was approved last year to allow them. Mr. Hill said that all changes would be made to comply with all staff comments.

Kenny Hill said that the only item of contention from the Subdivision Committee meeting was the parking on Threewood Court. The developer told Mr. Hill that he wanted to use Reserve G for landscaping and thought that parking in this area would be a detriment to the plan. After the Subdivision Committee meeting the developer said he would use Reserve G for parking if that is what the Planning Commission wanted. Mr. Hill also had discussions with the owner about parking along Onewood Court. The owner said that parking in this area would be too close to the rear doors of these houses.

Quentin Coon asked if there were any sidewalks in this addition. Kenny Hill said there are not sidewalks on cul-de-sac streets, only on collector streets. Lynn Heath said there is a sidewalk on Onewood Drive.

Keith Zinn asked if all these homes would be of the same architecture. Kenny Hill said he did not know and that it would be up to the developer.

Keith Zinn asked Jeff Bridges if the City Council approved this area to be restricted to senior citizen housing. Jeff Bridges said that it was not restricted.

Keith Zinn asked Jeff Bridges if all these homes would be of the same architecture. Mr. Bridges said that is an issue for the developer to decide. Kenny Hill said there is nothing in the PUD text for a requirement for similar architecture.

Les Mangus said there were no restrictions placed on this zoning case when it was heard in December of 2002.

Keith Zinn asked if there would be a brick wall built to screen between the R-2 and R-4 zoning districts. Kenny Hill said that there is a 6' fence required by the PUD in this area and that behind Lot 10 the fence would be wrought iron.

There was general discussion about the lot and block numbers on the plat.

Les Mangus said that on the south side of this development a change has been proposed since the Subdivision Committee to redraw the property line in a "z" where it used to be straight This is to preserve the wooded draw as a buffer between the patio homes and the B-4 zoning from that point out to the highway. Les said that makes some of the lots "odd" shaped but he thinks this is the right thing to do being a natural buffer. Kenny Hill said this would match the drainage in this area.

Lynn Heath asked if Reserve A is the creek. Kenny Hill said that it is.

Clark Nelson asked if there were any other changes made from the Subdivision Committee. Les Mangus said that Westar Energy sent a letter requesting some additional easements and Kenny Hill is working this issue out with them. Les Mangus said Westar Energy is asking for additional easements along the following areas:

Onewood Drive, on the south end of the patio homes

one in-between lots 15 & 16 in the patio homes

 

3.

on Putter Circle between Lots 3 & 4

 

4.

on Douglas Ct. between Lots 12 & 13

 

5.

all along the east side of Lots 10 - 15 of the patio homes

 

 

 

Kenny Hill said they would work with Westar Energy to provide the easements they need to install their transmission lines, however they may negotiate with them on some easements to preserve the tree lines. Other locations will be provided for the utility if necessary.

 

 

 

Jan Cox asked why some of the lots have the square footage noted and other lots do not. Kenny Hill said that he provided square foot area on certain lots to satisfy the staff comments. Les Mangus said the obvious or simple rectangle lot areas were not specifically noted on the plan.

Clark Nelson made a motion to approve the Preliminary Plat of Green Valley 10th Addition subject to the satisfaction of the staff comments. Charlotte Bass seconded the motion. Motion carried 5/0.

Quentin Coon asked how to handle the open-ended easement. Les Mangus said they would have to be negotiated out with the utility companies before the plat goes to the City Council for acceptance for the street right-of-ways and easements.

 

 

 

Review the Final Plat of the Course at Green Valley 10th Addition. Kenny Hill of Poe and Associates, representing the applicant said the changes on the south side have not been made to the drawing that was included in the Commission packets. He said these would be done. Mr. Hill provided a small sketch to show dimensional changes to get 100' depth on all the lots as requested by staff. The other changes made were to the platter's text, which he submitted to the Commission before the meeting. This change dealt with the gated entry being limited to the private street only in the new text. It states the fence will be installed by the developer and maintained and owned by the homeowners association.

Lynn Heath asked if a fence would be built along Onewood Drive for the gate to connect to on the private street. Kenny Hill said he did not know the answer to this. The platter's text would allow the construction of a gated entry in Reserves B and C.

Les Mangus said the 10' dimension on the east edge is to encompass the row of trees they are trying to preserve that is between the Onewood Drive right-of-way and the east side of these lots. Kenny Hill said the change in the text is to allow parking in Reserve G.

Clark Nelson made a motion to approve the Final Plat of the Green Valley 10th Addition subject to staff comments and working out utility easements with Westar Energy. Lynn Heath seconded the motion. Motion carried 5/0.

 

Keith Zinn asked to be shown where the row of trees is that were in question earlier in the meeting. Les Mangus said they are in Reserve B and Reserve C.

Member Items: Les Mangus said the first meeting of the Comprehensive Plan Committee is Thursday night at 6:30 p.m. at the Conference Cabin. Jeff Bridges said the first meeting will be discussion on how to conduct the public input sessions.
